Court halts Makerere guild boss from oath

COURT has stopped the swearing-in of Henry Maurice Kibalya as the Makerere Guild President.

COURT has stopped the swearing-in of Henry Maurice Kibalya as the Makerere Guild President.

Justice Remmy Kasule put off the ceremony, which was scheduled for this week, on the request of the second runner-up, Jet John Tumwebaze.

“This court is satisfied that an interim order be issued, that the swearing-in of the Guild President of Makerere University 2005/2006 be stayed,” ruled Kasule.

Kasule said the order would be in place till May 11, when it would be reviewed, if need arose.

This was after Tumwebaze filed a suit, accusing Prof. Livingstone Luboobi, Makerere’s Vice-Chancellor, of ‘influencing the guild electoral commission (EC)’ to return Kibalya as the winner, ahead of him (Tumwebaze).

Tumwebaze’s lawyers, Ntambirweki, Kandeebe, Kwarisiima and Company Advocates claimed the university organised the swearing-in without naming a tribunal to hear his petition first.

Tumwebaze also sued the University Council and the EC chairman, accusing him of accepting to be influenced by Luboobi in announcing Kibalya the winner.

Justice Kasule, however, declined to hear Tumwebaze’s plea for permission to file a substantive case for the review of the chaotic polls, in absence of the accused.
